Supplier Code of Conduct

MUT Shipping Customs Supplier Code of Conduct: Labor Code Compliance, Worker Rights, and Social Sustainability

Purpose: This Supplier Code of Conduct outlines the standards and expectations for all suppliers and subcontractors (collectively referred to as "suppliers") of MUT Shipping Customs regarding labor code compliance, worker rights, and social sustainability. It is our commitment to uphold ethical practices throughout our supply chain in accordance with California and United States laws and regulations.

  1. Legal Compliance: Suppliers must comply with all applicable local, state, federal, and international laws and regulations relating to labor and employment, including but not limited to:
  • California Labor Code: Adherence to all provisions concerning wages, hours worked, breaks, and working conditions.
  • U.S. Fair Labor Standards Act (FLSA): Compliance with minimum wage, overtime pay, child labor laws, and record-keeping requirements.
  • Occupational Safety and Health Administration (OSHA) Standards: Providing a safe and healthy work environment, including appropriate safety training and equipment.
  • Equal Employment Opportunity (EEO) Laws: Prohibiting discrimination based on race, color, religion, sex, national origin, disability, or age.
  1. Worker Rights:
  • Freedom of Association: Respecting the rights of workers to join or not join labor unions and engage in collective bargaining where legally permissible.
  • No Forced or Child Labor: Prohibiting the use of forced, bonded, indentured, or involuntary labor of any kind. Ensuring that workers are at least the legal minimum age or older, whichever is higher.
  1. Working Conditions:
  • Safe and Healthy Workplace: Providing a workplace that is free from recognized hazards that could cause harm to workers' health or safety.
  • Fair Treatment: Treating all workers with respect and dignity, ensuring no physical, verbal, psychological, or sexual harassment or abuse.
  1. Compensation and Benefits:
  • Wages and Benefits: Providing wages and benefits that meet or exceed the legally mandated minimum standards, including overtime compensation where applicable.
  • Hours of Work: Complying with maximum hours of work regulations and providing adequate rest breaks and meal periods.
  1. Social Sustainability:
  • Environmental Responsibility: Complying with environmental laws and regulations, and promoting sustainable practices where possible.
  • Community Engagement: Engaging with local communities in a positive and responsible manner, respecting cultural and social norms.
  1. Monitoring and Compliance:
  • Reporting Violations: Promptly reporting any violations or concerns related to this Code of Conduct to Walker Goss.
  1. Commitment to Improvement:
  • Continuous Improvement: Collaborating with suppliers to implement corrective actions and improvements where violations are identified, with a focus on preventing future occurrences.
  • Training and Awareness: Providing training and resources to suppliers to enhance understanding and implementation of this Code of Conduct.
  1. Non-Retaliation:
  • Protection of Whistleblowers: Ensuring that workers and suppliers are protected from retaliation for reporting violations of this Code of Conduct or raising concerns in good faith.
  1. Enforcement:
  • Contractual Obligation: Incorporating compliance with this Code of Conduct into supplier agreements and contracts, with provisions for termination of contracts in cases of non-compliance.
  • Consequences of Non-Compliance: Taking appropriate disciplinary action, up to and including termination of business relationships, for suppliers found to be in violation of this Code of Conduct.
  1. Communication:
  • Accessibility: Making this Supplier Code of Conduct readily accessible to all suppliers, workers, and stakeholders, and communicating its principles effectively across our supply chain.

Conclusion: This Supplier Code of Conduct reflects MUT Shipping Customs commitment to ethical business practices and social responsibility. By adhering to these standards, we aim to create a sustainable and respectful supply chain that benefits workers, communities, and the environment.

Approval: This Supplier Code of Conduct has been approved by Walker Goss. Suppliers are expected to acknowledge their understanding and compliance with this Code of Conduct upon entering into contracts with MUT Shipping Customs.

Effective Date: This Supplier Code of Conduct is effective as of 7/1/2024 and supersedes any previous versions.
